INTRODUCTION

Human creativity and inventiveness has lead to the development of intellectual property all around us affecting our daily lives. Intellectual Property has assumed great importance in the modern era of industrialization and the words "Intellectual Properly" popularly known as IP is a buzz word throughout the world today. Every product or service that we use in our daily lives is the result of a long chain of big or small innovations, such as changes in designs, or improvements that make a product look or function the way it does today.


HOW THIS RELATES TO BUSSINESS?

Regardless of what product the enterprise makes or what service it provides, it is likely that it is regularly using and creating a great deal of intellectual property. If this is the case, one should systematically consider the steps required for protecting, managing and enforcing it, so as to get the best possible commercial results from its ownership. If one is using intellectual property that belongs to others, then one should think on buying it or acquiring the rights to use it by taking a license in order to avoid a dispute and consequent expensive litigation. Almost every MSME has a trade name or one or more trademarks and should consider protecting them. Most MSMEs will have valuable confidential business information, from customers' lists to sales tactics that they may wish to protect. A large number would have developed creative original designs. Many would have produced, or assisted in the publication, dissemination or retailing of a copyrighted work. Some may have invented or improved a product or service. In all such cases, MSME should consider how best to use the IP system to its own benefit. IP may assist MSME in almost every aspect of business development and competitive strategy: from product development to product design, from service delivery to marketing, and from raising financial resources to exporting or expanding your business abroad through licensing or franchising.


The strategic utilization of IP assets can substantially enhance the competitiveness of MSME. MSMEs should make sure that they are ready to face the challenge and take measures to exploit their IP and protect it wherever possible. Like physical assets, IP assets must be acquired and maintained, accounted for, valued, monitored closely, and managed carefully in order to extract their full value. But before this can be done, MSMEs must first acknowledge the value of IP and begin to see it as a valuable business asset.


This workshop will exactly help to achieve this. It will help in enlightening participants on patent prosecution procedures; understand essentialities of patent drafting and documentation required for prosecution of application in Indian and International patent offices.


OBJECTIVE

This course is for understanding the patent prosecution at the patent office, acquiring drafting skills for preparation of patent specifications and other documents required for prosecution of patent applications in Patent Office in the context of Indian and International patent applications.
The objectives of the course are as follows:

  • Understanding the provisions of The Patents Act 1970 and the rules thereunder
  • Patent procedure and prosecution at the Patent Office.
  • Provisions relating to International application under The Patents Act 1970 and rules
  • Drafting patent specifications and documents for patent prosecution

  • Understand the role of patent agent and formalities of registration
